As we begin this session, our minds are full of images in recent days of the death and funeral services of Diana, Princess of Wales, and mourning for Mother Teresa of Calcutta. We also carry the memory of our former Speaker's fall from grace, Missouri's three executions in August with a fourth halted, embarrassing news of the charges of mistreatment of Missouri prisoners in Texas and a renewed debate about partial birth abortions for the upcoming veto session on Wednesday.

Gracious God, as we mourn Diana and Teresa, we see two people, one coming from wealth and glamour to help the poor and abandoned, the other coming from the poor and abandoned to the wealthy asking for help; both challenged our hearts to openness.

We pray for all these memories, these mixed emotions and complex ethical issues which face us constantly in our work here and personally. Guide us with Your love and what ever discernment it takes to address the issues facing us this week. Bless our two new members as we welcome them today. Amen.

MESSAGE FROM THE GOVERNOR

The following Proclamation was received from His Excellency, Governor Mel Carnahan.

PROCLAMATION

WHEREAS, in the case of Tillis, et al v. City of Branson, the Supreme Court of Missouri held that the local tourism tax approved by voters was authorized pursuant to a state law which suffered from a constitutional defect which rendered the City of Branson powerless to impose the voter approved tax; and

WHEREAS, the city of Branson is subject to severe negative economic consequences if legislation to remedy the constitutional defect is not passed and approved; and

WHEREAS, the Department of Economic Development is an executive department of the State of Missouri, as enumerated in Article IV, Section 12 of the Missouri Constitution and the Reorganization Act of 1974; and

WHEREAS, Article IV, Section 36(a), authorizes the Department of Economic Development " to administer all programs provided by law relating to the promotion of the economy of the state, the economic development of the state, trade and business, and other activities and programs impacting on the economy of the state;" and

WHEREAS, the Eighty-Ninth General Assembly Truly Agreed and Finally Passed Conference Committee Substitute for House Committee Substitute for Senate Substitute for Senate Bill No. 165; and

WHEREAS, said bill was vetoed by me for the reasons stated in my veto message which is attached hereto and incorporated herein; and

WHEREAS, Conference Committee Substitute for House Committee Substitute for Senate Substitute for Senate Bill No. 165 did contain programs and activities related to or coordinated by the Department of Economic Development; and

WHEREAS, certain programs and activities related to or coordinated by the Department of Economic Development and contained in Conference Committee Substitute for Hosue Committee Substitute for Senate Substitute for Senate Bill No. 165 are crucial to the immediate economic future of the State of Missouri because of their impact on the relocation or establishment of new businesses and the subsequent impact on job opportunities for all of Missouri citizens, as well as the economic health of towns, cities and counties, both urban and rural, in the State of Missouri; and

WHEREAS, Article IV, Section 9 of the Missouri Constitution, authorizes the Governor, "on extraordinary occasions [to] convene the general assembly by proclamation, wherein he shall state specifically each matter on which action is deemed necessary;" and

WHEREAS, the need to amend the Statutes of Missouri relating to (A) potential constitutional defects in the local tourism taxes currently authorized pursuant to state law, and, (B) certain programs and activities related to or coordinated by the Department of Economic Development is an extraordinary occasion as envisioned by Artice IV, Section 9, of the Constitution of the State of Missouri.

NOW THEREFORE, on the extraordinary occasion that exists in the State of Missouri:

I, MEL CARNAHAN, GOVERNOR OF THE STATE OF MISSOURI, pursuant to the authority vested in me as Governor by the Constitution of the State of Missouri, do, by this Proclamation, convene the Eighty-ninth General Assembly of the State of Missouri in the Second Extra Session of the First Regular Session; and

I HEREBY call upon the Senators and Representatives of said General Assembly to meet in their respective chambers in the State Capitol in the City of Jefferson at the hour of 4:00 p.m., Central Daylight Time, September 8, 1997; and

I HEREBY state that the action of said General Assembly is deemed necessary concerning each matter specially designated and limited hereinafter as follows:

(A) To remedy potential constitutional defects in the local tourism taxes currently authorized pursuant to state law; and

(B) To consider legislation relating to the following programs and activities related to or coordinated by the Department of Economic Development:

1. Tax Increment Financing

2. Missouri Development Finance Board

3. The Business Use Incentives for Large Scale Development Program

4. Enterprise Zones

5. Bank Community Development Corporation Tax Credits

6. Youth Opportunities and Violence Prevention Tax Credits

7. Certified Capital Companies

8. Ordering of Tax Credits

9. Mutual Funds Investment Companies

10. Community College New Jobs Training Program

11. Rehabilitation of Certified Historic Structures

12. Establishment of a property reuse revolving fund for what is popularly known as the Brownfields Program

13. Contracting Authority of Department of Economic Development

14. Research and Development Tax Credits

15. Microenterprise Loans

16. International Economic Development Exchange Program

17. Task Force on Trade and Investment

18. Community Development Corporations

19. Workfare Renovation Project

TO ALL MEMBERS OF THE EIGHTY-NINTH GENERAL ASSEMBLY OF THE STATE OF MISSOURI

WHEREAS, by my proclamation dated August 25, 1997, I convened the Eighty-ninth General Assembly of the State of Missouri in the Second Extra Session of the First Regular Session; and

WHEREAS, it has come to my attention that additional extraordinary matters need to be considered during this Second Extra Session; and

WHEREAS, the said Second Extra Session of the General Assembly has convened in the City of Jefferson on September 8, 1997, pursuant to my call:

NOW THEREFORE, I, MEL CARNAHAN, GOVERNOR OF THE STATE OF MISSOURI, pursuant to the authority vested in me as Governor by the Constitution of the State of Missouri, do hereby amend the matters specifically designate in said Proclamation for consideration by the General Assembly as follows:

I HEREBY state that the action of said General Assembly is deemed necessary concerning each matter specially designated and limited hereinafter as follows:

(A) To remedy potential constitutional defects in the local tourism taxes current authorized pursuant to state law or in bills passed by the Eighty-ninth General Assembly during their First Regular Session as well as revisions ancillary to authorization of said tourism taxes, and to enact such remedies and revisions with an emergency clause; and

(B) To consider legislation relating to the following programs and activities coordinated or administered by the Department of Economic Development:

1. Tax Increment Financing

2. Missouri Development Finance Board

3. The Business Use Incentives for Large Scale Development Program

4. Enterprise Zones

5. Bank Community Development Corporation Tax Credits

6. Youth Opportunities and Violence Prevention Tax Credits

7. Certified Capital Companies

8. Ordering of Tax Credits

9. Mutual Funds Investment Companies

10. Community College New Jobs Training Program

11. Rehabilitation of Certified Historic Structures or structures in a Certified Historic District

(C) To allow the Senate to consider appointments to boards, commissions, departments and divisions that require the advice and consent of the Senate; and

(D) To amend the deadline for notification to election authorities of matters intended to be submitted to the voters for elections which are authorized by newly enacted statutes or statutes whose effective date is after the current deadline for notice to election authorities of the call for an election, and to enact such legislation with an emergency clause in order for municipalities to utilize the legislation enacted during this second extra session; and

(E) To consider legislation relating to nonprofit sewer companies and the regulation of waste water treatments within watershed regions; and

(F) To consider legislation authorizing a municipal general sales tax subject to voter approval, and which contains a sunset provision and which tax would be used for the purpose of promoting economic development through the construction of a convention center.

(G) Such additional and other matters as may be recommended by the Governor by special message to the General Assembly after it shall have convened.

WHEREAS, by my Special Message dated September 8, 1997, I expanded the matters specifically designated in said Proclamation; and

WHEREAS, "The Contracting Authority of the Department of Economic Development" was inadvertently deleted from section B of the Special Message which contained the programs and activities coordinated or administered by the Department of Economic Development to be considered during this Second Extra Session.

NOW THEREFORE, I, MEL CARNAHAN, GOVERNOR OF THE STATE OF MISSOURI, pursuant to the authority vested in me as Governor by the Constitution of the State of Missouri, in addition to those matters specifically designated in said Special Message for consideration by the General Assembly do hereby include under section B of said Special Message:

"The Contracting Authority of the Department of Economic Development"

BE IT RESOLVED, by the House of Representatives that all members of the House of Representatives shall be reimbursed for their actual and necessary expenses incurred while attending duly called meetings of any standing committee of the House or Senate in the state or meetings of the Senate during the Second Extraordinary Session of the First Regular Session of the Eighty-ninth General Assembly on the days that the House does not meet; and

BE IT FURTHER RESOLVED, that the expenses payable under this resolution shall not be paid to any member who qualifies for any other type of reimbursement and shall not exceed the legislative per diem allowed; and

BE IT FURTHER RESOLVED, that, upon approval of the Speaker of the House, the expenses of the House members be paid from the House or Joint contingent fund of the House.

HOUSE RESOLUTION NO. 4

Whereas, the members of the Missouri House of Representatives proudly but solemnly pause to commemorate one of the lesser-known episodes of the Second World War; and

Whereas, on Christmas Eve, 1944, there occurred a catastrophe that had remained virtually unknown for more than a half century; and

Whereas, wartime censorship prohibited any official report of this historic event which came to light only recently with the July, 1997, publication of Allan Andrade's book, S.S. Leopoldville Disaster, December 24, 1944; and

Whereas, on December 24, 1944, a Belgian troopship, the S.S. Leopoldville, met disaster as the target of a torpedo attack by a German submarine; and

Whereas, at the time of this tragic incident, the S.S. Leopoldville was transporting members of the 66th (Black Panther) Infantry Division to fight in the Battle of the Bulge; and

Whereas, the S.S. Leopoldville, which was carrying 2,235 American soldiers, sank, and official records claim 802 of those brave warriors perished; and

Whereas, thirty-one soldiers from the great state of Missouri were among the 802 Americans who lost their lives for the cause of freedom on that infamous day; and

Whereas, on November 7, 1997, a special monument commemorating the Leopoldville Disaster will be dedicated during a solemn ceremony to take place at Fort Benning, Georgia:

Now, therefore, be it resolved that we, the members of the Missouri House of Representatives, Eighty-ninth General Assembly, join unanimously in expressing our heartfelt gratitude to all those courageous, young Americans, including those who perished and those who survived, for the enormous sacrifice they had made and the unparalleled bravery they had displayed as soldiers committed to pride, honor, loyalty, and duty despite the horrors of war; and

Be it further resolved that the Chief Clerk of the Missouri House of Representatives be instructed to prepare a properly inscribed copy of this resolution for presentation during the forthcoming dedication ceremony.

Dear Speaker Gaw:

Please be informed that I hereby resign my position as State Representative of the 3rd Legislative District of the Missouri House of Representatives to be official on August 11, 1997 at 12:00 midnight. I will be assuming a new position with the Missouri Department of Economic Development.

I am deeply honored to have served with you and the many present and past members of the Missouri General Assembly. My tenure in the House has been a wonderful experience.

I take with me from the past eleven years many marvelous experiences and friendships. I believe with all my heart that the Missouri House of Representatives is the "peoples legislative body." We are a 163-member microcosm of this state. We reflect the opinions and positions of the 32,000 people we represent in our respective legislative districts. Running for office every two years continues to keep us in constant touch with the opinions, feelings, and thoughts of our constituents. The two-year term and the fact that we are always running for office is not a detriment. It makes us more politically reflective of the people we represent. It is the reason that we are the lower body and truly the "peoples house." We must always work to protect that.

We must all continue to work tirelessly to bring government closer to the people. In doing so, it is our responsibility to make government and public service something of which to be proud. I know that I certainly am.

I appreciate all that you and your staff have done for me and if I can ever by of any assistance in my new position, please don't hesitate to call upon me.
