Summary of the House Committee Version of the Bill

HCS SB 884 -- REPUBLICATION OF STATUTES

SPONSOR:  Klindt (Lager)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Judiciary by a vote of 16 to 0.

This substitute instructs the Revisor of Statutes to take certain
actions when the Missouri Supreme Court or a federal court rules
that a bill or a state statute is unconstitutional.  If a
repealed or amended statute is affected, the revisor will reprint
the statute as it existed before the enactment of the bill that
was declared unconstitutional.  If a new statute is affected, the
revisor will publish a footnote indicating the court decision and
explaining the reason for the removal of the statute.

FISCAL NOTE:  No impact on state funds in FY 2005, FY 2006, and
FY 2007.

PROPONENTS:  Supporters say that the bill gives the Revisor of
Statutes the authority to republish sections of law passed by the
General Assembly that are affected by constitutional court
rulings.

Testifying for the bill was Senator Klindt.

OPPONENTS:  There was no opposition voiced to the committee.
