SS SCS HB 1082 -- FEDERAL LAND ACQUISITION

This bill requires the federal government to obtain statutory
authorization from the General Assembly before acquiring land in
Missouri by eminent domain or condemnation for reforestation,
native American gaming, recreational, or agricultural purposes.

This bill requires the federal government to obtain statutory
authorization from the General Assembly to acquire land in
Missouri for reforestation, nuclear or toxic waste storage or
disposal, native American gaming, recreational, or agricultural
purposes.

FISCAL NOTE:  No impact on state funds.


COMMITTEE

HB 1082 -- FEDERAL LAND ACQUISITION

SPONSOR:  Crump

COMMITTEE ACTION:  Voted "do pass" by the Committee on Federal--
State Relations and Veterans Affairs by a vote of 12 to 2.

This bill requires the federal government to obtain statutory
authorization from the General Assembly to acquire land in
Missouri for reforestation, recreational, or agricultural
purposes.

FISCAL NOTE:  No impact on state funds.

PROPONENTS:  Supporters say that people are having their land
taken from them by the government.  Most people don't want to
sell.  The federal government has unlimited funds and can buy
all the land it wants.  Federal land purchases reduce the local
tax base.

Testifying for the bill was Representative Crump.

OPPONENTS:  Those who oppose the bill say that this bill will
prevent willing sellers from selling to the federal government.
Most people don't want to wait for the legislature to approve a
sale.  This bill will stifle private property rights.  The
federal government only owns 5% of the state's land.  The bill
will also slow transfer of land along Missouri's floodplain.

Testifying against the bill were Sierra Club; and Missouri
Coalition for the Environment.
