AN ACT

To repeal section 701.051, RSMo 1994, relating to inspection fees for on-site sewage disposal systems, and to enact in lieu thereof one new section relating to the same subject.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 701.051, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 701.051, to read as follows:

701.051. The department of health may charge a fee of up to fifty dollars for an inspection of an on-site sewage disposal system conducted pursuant to a request from a lending institution, a prospective purchaser, the owner of the property, a real estate agent or a real estate broker. [Inspections may be made at the request of a lending institution providing either a government loan or a conventional loan.] The fee for such inspection shall be paid by the requesting party. The fees collected by the department pursuant to this section shall be deposited in the Missouri public health services fund. The department of health may license and use private contractors to carry out the provisions of this section.
