COMMITTEE

HCS HB 1734 -- CRIMINAL ACTIVITY FORFEITURE ACT

SPONSOR:  Hosmer (Riley)

COMMITTEE ACTION:  Voted "do pass" by the Committee on Criminal
Law by a vote of 15 to 0.

This substitute creates a pilot program in Kansas City that
makes the criminal disposal of waste an activity that triggers
the Criminal Activity Forfeiture Act (CAFA).  Violations of CAFA
result in the civil forfeiture of all property used in or
realized through the commission of criminal activities.
However, removal of the dumped materials within 10 days of
notice of forfeiture proceedings will be a defense to the
proceedings.

FISCAL NOTE:  Not available at time of printing.

PROPONENTS:  Supporters say that the penalties for dumping,
especially in urban areas, need to be stiffer than the current
fine.  Similar efforts in other cities have greatly reduced the
dumping of bulky objects.

Testifying for the bill was Representative Riley.

OPPONENTS:  There was no opposition voiced to the committee.

This bill includes the criminal disposal of waste in the list of
activities that trigger the Criminal Activity Forfeiture Act
(CAFA).  Violations of CAFA result in the civil forfeiture of
all property used in or realized through the commission of
criminal activities.
