HB 1303 -- Motor Vehicle Financial Responsibility

This bill makes any person who fails to maintain financial
responsibility or operates a vehicle owned by another knowing
the owner has not maintained financial responsibility and the
person's own coverage does not cover other vehicles guilty of a
class C misdemeanor and subject to a fine of at least $100.
The bill requires that at the time of registration vehicle
owners present a copy of a receipt that shows proof that
financial responsibility for such vehicle was maintained during
the previous year or if the vehicle was owned less than one
year, that financial responsibility was maintained during that
time. If proof is not supplied, the director may register the
vehicle and initiate proceeding against the registrant for
failure to maintain proof of financial responsibility.
Any insurer that issues motor vehicle liability policies in the
state must inform the Director of Revenue if any policy issued
is cancelled by an insurer within 30 days of the cancellation.
The insurer must also notify the insured at the time of the
cancellation that the insurer is required by law to inform the
director of cancellation and that the insured is required to
show proof of financial responsibility for the prior
registration period to the director at the time the insured
renews the registration of the vehicle.
