The rains continue to fall, O God of Creation, and once again we see nature taking a
destructive turn. Help us to hold fast to the knowledge that you are the God of all that is
and help those whose lives are being disrupted by flood or tornados. And yet even in the midst
of the destruction, we see the creative force that the rain also brings as it refreshes a
ground hardened by winter's cold dryness.
Lord, those inside these walls often are unaware of what is happening outside - sometimes
unaware of the weather, sometimes unaware of the people. Keep these representatives in tune
with those they represent and help them give a listening and hearing ear to the voices that
elected them. Give them wisdom; give them courage; give them hope to see accomplished what
will most benefit the people of Missouri.
And now, O God, we ask your presence in this room, in the hearts and minds and souls of those
present, that we might all know of your loving care for us. Guide the decisions made today -
may they be directed by your hand. Amen.

MESSAGES FROM THE SENATE
Mr. Speaker: I am instructed by the Senate to inform the House of
Representatives that the Senate refuses to recede from its position on SA 1,
SSA 1 for SA 3, SSA 1 for SA 4 and SA 5 to HB 811 and grants the House a
conference thereon.
The President Pro Tem has appointed the following Conference Committee to act
with a like Committee from the House: Senators Moseley, Banks, Wiggins, Sims
and Singleton.
Mr. Speaker: I am instructed by the Senate to inform the House of
Representatives that the President Pro Tem has appointed the following
Conference Committee to act with a like Committee from the House on HCS SB
914: Senators Quick, DePasco, Clay, Treppler and Klarich.
PERFECTION OF HOUSE BILL - APPROPRIATIONS
HB 1019, with House Committee Amendment No. 1, relating to appropriations, was
taken up by Representative Lumpe.
On motion of Representative Lumpe, House Committee Amendment No. 1 was
adopted.
On motion of Representative Lumpe, HB 1019, as amended, was ordered perfected
and printed.
BILL IN CONFERENCE
HCS SS SB 687, as amended, relating to special school district, was taken up
by Representative Lumpe.
Representative Lumpe requested that the conferees on HCS SS SB 687, as
amended, be allowed to exceed the differences in two areas; first, by giving
the Governing Council greater authority to approve the Board's budget and
second, to give the public review committee authority to put issues on the
ballot, which address the structure and the board, for the voters of St. Louis
County to decide.
Which motion was adopted.

HOUSE CONCURRENT RESOLUTION
HCR 13, relating to privatization of the St. Louis Metropolitan sewer
district, was taken up by Representative Carter.
Representative Foley offered House Amendment No. 1.
House Amendment No. 1
AMEND House Concurrent Resolution No. 13, page 1, line 29, by inserting after the word
"senate" the following: "At least 3 members from House and 3 members from Senate shall be
residents of St. Louis County."
On motion of Representative Foley, House Amendment No. 1 was adopted.
On motion of Representative Carter, HCR 13, as amended, was adopted.
HOUSE BILL WITH SENATE AMENDMENTS
SS SCS HB 974, relating to sex offenders, was taken up by Representative Crump
(152).
Representative Crump (152) moved that the House refuse to adopt SS SCS HB 974
and ask the Senate to recede from its position on SS SCS HB 974 and, failing
to do so, grant the House a conference and allow the conferees to exceed the
differences in order to increase the mandatory minimum time for those
defendants who have a prior conviction for child molestation or sexual abuse
in the first degree when classified as a B felony when the defendant has been
found to be a predatory sexual offender.

AMEND House Committee Substitute for Senate Bill No. 904, page 1, In the Title, line 3, by
deleting the word "five" and inserting in lieu thereof the word "six"; and
Further amend said bill, page 1, section A, line 1, by deleting the word "five" and inserting
in lieu thereof the word "six"; and
Further amend said bill, page 1, section A, line 2, by deleting "3 and 4" and inserting in
lieu thereof the following: "3, 4 and 5"; and
Further amend said bill, page 4, section 4, line 18, by inserting after all of said line the
following:
"Section 1. 1. The governing body of each noncharter county shall have power to adopt clearly
reasonable ordinances, resolutions or regulations relating to its property, affairs and local
government for which no provision has been made by general law or the Constitution of Missouri
and the general laws of the state. Any such ordinance shall remain in force until repealed or
amended by the governing body; except that, the general assembly may further define, broaden,
limit or otherwise regulate the power of noncharter counties to pass clearly reasonable
ordinances, resolutions or regulations.
2. The governing body of a noncharter county may submit to the voters of that county any
ordinance, resolution or regulation proposed pursuant to subsection 1 of this section for the
approval of the voters of that county. Such ordinance, resolution or regulation shall then
either pass or not pass according to the vote of a majority of those voters registered in the
noncharter county who vote on the proposal.
3. Upon the receipt of a petition signed by at least five percent of the total number of
voters from the noncharter county who voted for governor in the last gubernatorial election,
the governing body of that county shall place any clearly reasonable ordinance, resolution or
regulation, which the county government of that county would otherwise be able to adopt
pursuant to subsection 1 of this section, on the ballot at the next general election for the
approval of the voters of that county. The proposed ordinance, resolution or regulation must
be clearly printed at the top of the petition before the signatures on the petition are
acquired.".

pregnancy testing and follow-up services

For funding to local health departments and licensed hospitals to provide
alternative to abortion services for pregnant women
From General Revenue....................................$900,000"
and further that the House conferees be otherwise bound to the current
proposed conference committee substitute;
and further that the conferees be authorized to exceed the differences for the
above purpose and for no other purpose.
Representative Lumpe raised a point of order that the substitute motion is a
negative motion and cannot be offered until Representative Carter's motion is
acted on.

the substitute motion the House would have to reconsider the vote by which the
bill was third read and the vote by which the bill was perfected.

AMEND Senate Committee Substitute for Senate Bill No. 726, Page 1, In the Title, Line 2, by
striking out the words "one new section" and inserting in lieu thereof the following: "two new
sections"; and
Further amend said bill, Page 1, Section A, Lines 1 and 2, by striking out the words "one new
section" and inserting in lieu thereof the following: "two new sections"; and
Further amend said bill, Page 1, Section A, Line 2, by striking out the word and numeral
"section 192.031" and inserting in lieu thereof the following: "sections 192.031 and 192.038";
and
Further amend said bill, Page 1, Section 192.031, Line 14, by inserting immediately after said
line the following:
"192.038. Any abortion facility as defined in section 188.015, RSMo, which holds itself out to
the public as providing abortions and which is not required under the law to be licensed as an
ambulatory surgical center shall be inspected at least annually by the department of health,
and may be inspected at any time for good cause. The department shall promulgate all rules
necessary for the operation of unlicensed abortion facilities to ensure that such facilities
are operated as safely for employees and patients as licensed abortion facilities, and to
ensure that abortions are performed or induced as safely in such facilities as in licensed
abortion facilities. If an unlicensed abortion facility is suspected of violating any
provision of this section or chapter 188, RSMo, the department shall give twenty days' written
notice to the unlicensed abortion facility to comply. If the unlicensed abortion facility
fails to comply, the department may seek from a court of competent jurisdiction whatever
relief necessary to enforce the provisions of this section or of chapter 188, RSMo, and may
seek any other relief available under the law. No rule or portion of a rule promulgated under
the authority of this section shall become effective unless it has been promulgated pursuant
to the provisions of section 536.024, RSMo.".
