House Journal

Second Regular Session, 88th General Assembly

SIXTH-NINTH DAY, Tuesday, May 7, 1996

Speaker Pro Tem Daniels in the Chair.

Prayer by Reverend Cheryl L. Tatham.

The rains continue to fall, O God of Creation, and once again we see nature taking a destructive turn. Help us to hold fast to the knowledge that you are the God of all that is and help those whose lives are being disrupted by flood or tornados. And yet even in the midst of the destruction, we see the creative force that the rain also brings as it refreshes a ground hardened by winter's cold dryness.

Lord, those inside these walls often are unaware of what is happening outside - sometimes unaware of the weather, sometimes unaware of the people. Keep these representatives in tune with those they represent and help them give a listening and hearing ear to the voices that elected them. Give them wisdom; give them courage; give them hope to see accomplished what will most benefit the people of Missouri.

And now, O God, we ask your presence in this room, in the hearts and minds and souls of those present, that we might all know of your loving care for us. Guide the decisions made today - may they be directed by your hand. Amen.

The Pledge of Allegiance to the flag was recited.

The Speaker appointed the following to act as Honorary Pages for the Day, to serve without compensation: Janelle Hilbur, Johnny Lynch, Cadie Kroenke, Melana Batzold, Kirk Barron, Jerry Barnes, Jaime Sandburn, Nikki Thompson, Michael Park, Jennifer Hendrick, Scott David, Laura Arzola and Alan Buckrucker.

The Journal of the sixty-eighth day was approved as corrected.

Representative Carter moved that the House refuse to adopt CCR SCS HCS HB 1010, as amended, and request the Senate to recede from its position or, failing to do so, grant the House a further conference.

Representative Reynolds made a substitute motion that the House refuse to adopt Conference Committee Substitute for Senate Committee Substitute for House Committee Substitute for House Bill No. 1010 and request the Senate to grant further conference on Senate Committee Substitute for House Committee Substitute for House Bill No. 1010 and that the House conferees be instructed to adopt the following corrective language in lieu of Senate Substitute Amendment No. 1 for Senate Amendment No. 2 to Senate Committee Substitute for House Committee Substitute for House Bill No. 1010:

"For funding to local health departments and licensed hospitals to provide pregnancy testing and follow-up services

From General Revenue.....................................$664,000

For funding to local health departments and licensed hospitals to provide alternative to abortion services for pregnant women

From General Revenue....................................$900,000"

and further that the House conferees be otherwise bound to the current proposed conference committee substitute;

and further that the conferees be authorized to exceed the differences for the above purpose and for no other purpose.

Representative Lumpe raised a point of order that the substitute motion is a negative motion and cannot be offered until Representative Carter's motion is acted on.

Representative Jacob raised a second point of order that in order to take up the substitute motion the House would have to reconsider the vote by which the bill was third read and the vote by which the bill was perfected.

The Chair ruled the points of order not well taken.

Representative Jacob offered House Amendment No. 1 to the House substitute motion.

                            House Amendment No. 1

Representative Lograsso raised a point of order that House Amendment No. 1 to the House substitute motion for the House motion is in the third degree.

The Chair ruled the point of order not well taken.

Representative Reynolds raised a point of order that House Amendment No. 1 is not germane to the House substitute motion.

Representative Reynolds withdrew his point of order.

Representative Liese raised a point of order that House Amendment No. 1 is amending previously amended material.

The Chair ruled the point of order not well taken.

Representative Jacob moved that House Amendment No. 1 be adopted.
