HB 776 -- Merchandising Practices

This bill requires that after January 1, 1999, no express
warranty for any new motor vehicle will be for less than a 5
year period or for a term of not less than the amount of time
which expires between the date of sale, distribution, or
transfer and the date that the motor vehicle attains 100,000
miles.
After January 1, 1999, no express warranty for a new motor
vehicle will become effective unless it is approved by the
Attorney General. Any person who intends to sell, distribute,
or otherwise transfer any new motor vehicle to a consumer with
an express warranty must notify the Attorney General at least 14
days prior to any sale, distribution, or transfer.
It will be a class A misdemeanor for any person to: (1) fail to
comply with the notice requirement; (2) provide the Attorney
General any false or misleading information; (3) represent to
any person that the filing of the notice of the express warranty
constitutes an endorsement or approval of the express warranty
by the Attorney General.
