HCS HB 819 -- PUBLIC ACCESS TO AUTOMATED EXTERNAL DEFIBRILLATOR ACT SPONSOR: Cooper COMMITTEE ACTION: Voted "do pass" by the Committee on Health Care Policy by a vote of 10 to 0. This substitute establishes the Public Access to Automated External Defibrillator Act which grants immunity for civil damages to any person who gratuitously and in good faith renders medically appropriate emergency care using an automated external defibrillator, the person or entity that owns the defibrillator, and the person or entity that provided the clinical protocol for an automated external defibrillator site or program. The provisions of the substitute will not apply when the person acts in a willful and wanton or reckless manner in providing the care, advice, or assistance. FISCAL NOTE: No impact on state funds in FY 2010, FY 2011, and FY 2012. PROPONENTS: Supporters say that the bill will increase the usage of automated external defibrillators (AEDs), reduces obstacles to the use and availability of AEDs, protects people willing to take action in an emergency, and can deliver life-saving intervention.
