HB 1012 -- Background Checks for Long-Term Care Residents

This bill requires long-term care facilities to request a
criminal history background check on an individual 18 years of
age or older who is seeking full-time admission into the facility
within 24 hours of admittance and on all current residents by
January 1, 2010, at the resident's expense, for the purpose of
identifying sexual offenders.  The Department of Health and
Senior Services must keep continual record of residents who are
sexual offenders and report the number annually to the General
Assembly.  A criminal history analysis must be conducted by the
department within 14 days of receiving a report from the facility
to detail whether and to what extent a resident's criminal
history requires security measures to be implemented in the
facility.  Every facility must provide its residents with written
notice of their right to inquire whether any resident in the
facility is a sexual offender.
