Summary of the Introduced Bill

HB 1023 -- Mining in Residential Areas

Sponsor:  Dougherty

This bill prohibits blasting, excavation, and mining within 1,320
feet of any residentially zoned property within a political
subdivision of this state.  Any mining operation taking place on
or before the effective date of the bill may continue operations
to remove materials to the extent of its forward progress.
Forward progress will be judged by the closest point of
excavation for the purpose of removing significant quantities of
natural resources to the boundary of the residentially zoned
property, but will not include any excavation for the purpose of
testing or sampling.

The bill contains an emergency clause.
