HB 1052 -- Open School Enrollment

Beginning in school year 2010-2011, this bill allows a public
school student to attend a different school district other than
the one in which he or she lives, under conditions specified in
the bill.  The parent or guardian of the student must declare his
or her intent to use open enrollment by January 15 of the
preceding school year; and the receiving district must accept the
student if there is sufficient classroom space, as specified in
the bill.  The receiving district must notify the student within
five days of his or her acceptance.  If there is good cause for
missing the deadline, such as a change in residence or health or
safety concerns, the open enrollment request can still be
processed.  The bill contains provisions regarding returning to
the school district of residence, the handling of state aid,
transportation, special education, reporting of assessment
scores, the effect of open enrollment on small schools, and
eligibility for interscholastic competition.
