HB 1104 -- Mining Permits

This bill requires a new application for a mining permit to be
filed when an operator wants to amend an application and the Land
Reclamation Commission within the Department of Natural Resources
determines that the original application was complete.  Permit
applications may only be issued after an on-site inspection of
the mine is conducted by the department director, or his or her
designee, and a public meeting is held allowing public comment on
the permit request.  Notice of the public meeting must be
published in a newspaper or posted in other locations as
specified in the bill.  A notice of intent to operate a surface
mine must also be sent by certified mail to the last known
address of all landowners of record within 500 yards of the
proposed mine plan area instead of just the landowners of
contiguous or adjacent property to the proposed area.
