HB 410 -- Sale of Toys with Toxins

Beginning January 1, 2010, this bill prohibits any person or
entity from manufacturing, selling, or distributing any toy or
child care item for use by a child younger than three years of
age that can be placed in the child's mouth and contains more
than .1% diisononyl phthalate (DINP), diisodecyl phthalate
(DIDP), or di-n-octyl phthalate (DnOP).  Manufacturers cannot
replace phthalates with carcinogens rated by the United States
Environmental Protection Agency as an A, B, or C carcinogen; with
substances listed as, known to be, or suggestive of carcinogens
as described in the List of Chemicals Evaluated for Carcinogenic
Potential or known to the state to cause cancer; or with a
reproductive toxicant.

Anyone violating the provisions of the bill will be guilty of a
class D felony.
