Summary of the Introduced Bill

HB 896 -- Limited Liability for Geologic Sequestration Activities

Sponsor: Schoeller

This bill limits the liability of any public or private entity in
cases of personal injury or death related to a geologic
sequestration of carbon dioxide or other gases from a single
injection site to no more than $2 million with no individual
receiving more than $300,000. The limits will not apply to
workers' compensation cases, and no award will include punitive
or exemplary damages. If the amount awarded to or settled upon
by multiple claimants exceeds $2 million, any party may ask the
appropriate circuit court to apportion his or her proper share of
the total award.
