Summary of the Introduced Bill

HJR 35 -- Elections

Upon voter approval, this proposed constitutional amendment
requires a person to provide a form of photographic personal
identification to election officials in order to verify United
States citizenship prior to voting in a public election.  In its
main provisions, the amendment:

(1)  Requires the use of a valid driver's license; nondriver's
license; other specified documents with photographic
identification issued by the state or the United States; or
photographic identification issued by the Missouri National
Guard, the United States armed forces, or the United States
Department of Veterans Affairs to establish a voter's
qualification to vote;

(2)  Allows individuals who lack photographic identification to
vote by a provisional ballot that will be counted if proper
identification is later provided during voting hours;

(3)  Allows individuals who cannot obtain photographic
identification because of a physical or mental disability or
handicap or religious objection and those who were born on or
before January 1, 1941, to vote by provisional ballot upon
executing an affidavit affirming the reason;

(4)  Requires the state to provide at least one photographic form
of identification at no cost and to pay all costs for a
nondriver's license for anyone desiring one to vote who affirms
by affidavit that they do not have another type of photographic
identification sufficient for voting.  The Department of Revenue
must annually provide by January 1 to each member of the General
Assembly a report on the number of nondriver's licenses issued or
denied;

(5)  Requires the Secretary of State to publish and broadcast
these new voting requirements using a variety of specified media;
and

(6)  Requires each election authority to post a clear and
conspicuous notice at each polling place of the new requirements.
