HB 1705 -- SEWER SUBDISTRICTS IN CASS COUNTY

COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Rural Community Development by a vote of 10 to 0.
This bill authorizes an alternative procedure for issuing bonds
for a common sewer subdistrict partially or completely located in
Cass County by allowing the subdistrict to issue bonds if it
receives written approval from three-quarters of the customers of
the subdistrict. Currently, the bonds can only be issued upon a
four-sevenths majority approval of the voters of the subdistrict.
FISCAL NOTE: No impact on state funds in FY 2011, FY 2012, and
FY 2013.
PROPONENTS: Supporters say that the bill will allow an alternate
procedure for issuing bonds for a rural, unincorporated area to
provide sanitary sewer service to future residential and
commercial areas by reducing the required percentage of voter
approval.
Testifying for the bill were Representative Molendorp; and John
Reece, Little Blue Valley Sewer District.
OPPONENTS: There was no opposition voiced to the committee.
