Summary of the Committee Version of the Bill

HCS HB 1831 -- SCHOOL DISTRICT PROPERTY

SPONSOR:  Wallace (Jones, 117)

COMMITTEE ACTION:  Voted "do pass by consent" by the Committee on
Elementary and Secondary Education by a vote of 13 to 0.

This substitute allows a school district, after 10 years, to
return donated real property to the original donor or to sell it
as surplus.

FISCAL NOTE:  No impact on state funds in FY 2011, FY 2012, and
FY 2013.

PROPONENTS:  Supporters say that no statutory procedure exists to
return donated property.  This has created a problem for the
Prairie Home School District which has acquired property and is
unable to develop it as planned.

Testifying for the bill were Representative Jones (117); and
Larry Davis.

OPPONENTS:  There was no opposition voiced to the committee.

OTHERS:  Others testifying on the bill say procedures in Chapter
177, RSMo, require a district to go to bid, list property with an
agent, or deed it to another political subdivision.

Testifying on the bill was Department of Elementary and Secondary
Education.
