Summary of the Committee Version of the Bill

HCS HB 2043 -- CERTIFICATES OF OWNERSHIP FOR ALL-TERRAIN AND
OFF-HIGHWAY VEHICLES

SPONSOR:  Denison (Brown, 30)

COMMITTEE ACTION:  Voted "do pass by consent" by the Special
Committee on Infrastructure and Transportation Funding by a vote
of 9 to 0.

This substitute requires a person when applying for an original
certificate of ownership for an all-terrain vehicle or a
recreational off-highway vehicle to submit an affidavit
explaining how the vehicle was acquired and a photocopy of the
bill of sale establishing ownership of the vehicle.

FISCAL NOTE:  No impact on state funds in FY 2011, FY 2012, and
FY 2013.

PROPONENTS:  Supporters say that the bill will correct titling
consistency problems caused by the inability to title some used
all-terrain vehicles that were bought from individuals.

Testifying for the bill was Representative Brown (30).

OPPONENTS:  There was no opposition voiced to the committee.

OTHERS:  Others testifying on the bill say that there is a
problem with titling an all-terrain vehicle if the previous owner
had never obtained a title.  Currently, you must go to court to
fix the problem, but the bill will allow a person with an
affidavit and a copy of the bill of sale to obtain a proper title
through the Department of Revenue.
