HB 2082 -- FALSE REPORTS AGAINST DEPARTMENT OF CORRECTIONS EMPLOYEES SPONSOR: Fischer (107) COMMITTEE ACTION: Voted "do pass" by the Committee on Corrections and Public Institutions by a vote of 10 to 0. This bill prohibits an offender in the custody of the Department of Corrections from making a false report against any department employee by knowingly giving false information to an employee for the purpose of implicating any employee in a crime. Any offender violating the provisions of the bill will be guilty of a class D felony. FISCAL NOTE: No impact on state funds in FY 2011, FY 2012, and FY 2013. PROPONENTS: Supporters say that allegations against corrections officers are commonplace and when they are unfounded, officers have little recourse to get the report removed from his or her employment record because prosecutors seldom take any action against these types of misdemeanors. Testifying for the bill were Representative Fischer (107); and Missouri Corrections Officers Association. OPPONENTS: There was no opposition voiced to the committee. OTHERS: Others testifying on the bill say it may help deter these activities by charging inmates with a felony for making false statements. Testifying on the bill was Department of Corrections.Copyright (c) Missouri House of Representatives
