HB 2109 -- CLEAN WATER COMMISSION SPONSOR: Ruzicka COMMITTEE ACTION: Voted "do pass by consent" by the Committee on State Parks and Waterways by a vote of 7 to 0. This bill extends the public notice requirements of the Clean Water Commission when listing any impaired waters of the state under Section 303(d) of the federal Clean Water Act from August 28, 2010, to August 28, 2012. The commission's authority to charge fees for construction permits, operating permits, and operator's certifications related to water pollution control is extended from December 31, 2010, to December 31, 2012. FISCAL NOTE: No impact on state funds in FY 2011, FY 2012, and FY 2013. PROPONENTS: Supporters say that the bill is needed because the fees from the permits provide a large portion of the commission's funding, and the water pollution control permit fees have not changed in 10 years. Testifying for the bill were Representative Ruzicka; and Department of Natural Resources. OPPONENTS: There was no opposition voiced to the committee. OTHERS: Others testifying on the bill say it is working with agricultural groups to develop revisions to the concentrated animal feeding operation permits in response to the changes in federal law.
