Summary of the Introduced Bill

HB 1407 -- Uniform Premarital Agreement Act

Sponsor: Cox

This bill establishes the Uniform Premarital Agreement Act which
allows premarital contracts regarding most financial matters to
be entered into without the requirement of contractual
consideration. An agreement must be in writing and signed by
both parties and cannot alter court judgments regarding child
support payments or violate public policy. Courts may modify or
set aside an agreement based on typical contractual doctrines
including a lack of voluntary consent or lack of adequate
knowledge by one of the parties. Premarital agreements become
effective upon marriage and may only be amended or revoked by a
written agreement signed by the parties. If a marriage is
voided, the agreement is enforceable only to the extent necessary
to avoid an inequitable result.
