Summary of the Introduced Bill

HB 1513 -- Data Storage Centers and Server Farm Facilities

Sponsor: Flook

Beginning January 1, 2011, this bill authorizes a sales tax
exemption on all electrical energy, gas, water, and other
utilities including telecommunications services, machinery,
equipment, or computers and all retail sales of tangible personal
property and materials for the purpose of constructing,
repairing, or remodeling facilities used by data storage centers
and server farm facilities.

To be eligible for these exemptions, the facility must invest at
least $1 million every 12 months. This investment will apply to
both the initial equipment brought to the facility as well as any
subsequent equipment.

Facilities wishing to receive these exemptions must submit a
project plan to the Department of Economic Development, which
will certify the project in conjunction with the Department of
Revenue. The Department of Economic Development must conduct
random audits of projects to make certain that the intent of
these provisions is followed. Any construction of a facility
within a certified area will be phased in without any penalty or
time frame applied to its construction.
