Summary of the Introduced Bill

HB 1762 -- Municipal Ordinance Violations

Sponsor: Burnett

This bill specifies that the maximum fine for all municipal
ordinance violations will be $1,000 and the maximum sentence will
be imprisonment for 12 months; however, this provision will not
apply to a violation by an industrial user with any pretreatment
standard or requirement in Kansas City.

The authorization for any division of the circuit court to
contract with a private entity operating under a contract with a
state agency or the Office of State Courts Administrator for the
collection of delinquent court-ordered payments is repealed.

Currently, cities contracted by a municipal division of the
circuit court to provide probation and rehabilitation services
for persons in violation of city ordinances cannot be required to
pay any part of the cost of those services, and persons found
guilty or pleading guilty to municipal ordinance violations and
placed on probation must contribute a monthly service fee of
between $30 and $50 as determined by the sentencing court based
on certain enumerated factors. The bill repeals these
provisions.
