HB 2038 -- Liability for Geologic Sequestration Activities

Sponsor: Schoeller

This bill limits the liability of any public or private entity in
cases of personal injury or death arising from or related to the
geologic sequestration of carbon dioxide or other specified gases
in Greene County from a single injection site to no more than $2
million with no individual receiving more than $300,000. The
limits will not apply to workers' compensation cases, and no
award will include punitive or exemplary damages. If the amount
awarded to or settled upon by multiple claimants exceeds $2
million, any party may ask the appropriate circuit court to
apportion his or her proper share of the total award.
