HB 2173 -- Circuit Clerk's Record Preservation Fund

This bill authorizes a $3 fee to be assessed, in addition to all
other court costs, in all civil and criminal cases, including
violations of municipal or county ordinances heard by an
associate circuit judge, or any violation of criminal traffic
laws including infractions.  The $3 fee will not be collected in
any proceeding involving a violation of an ordinance or state law
when the criminal proceeding or the defendant has been dismissed
by the court or when costs have been waived or paid by the state,
county, or municipality.  The court clerk must retain $2 of this
fee to be deposited into the circuit clerk's record preservation
fund to be used for record storage, microfilming, preservation,
and public access of court records.  The fund cannot be used to
substitute for or subsidize any allocation of general revenue for
the operation of the circuit clerk's office without the express
consent of the circuit clerk.
