Summary of the Introduced Bill

HB 2456 -- State Sovereignty Commission

This bill establishes the State Sovereignty Commission consisting
of seven members including two senators appointed by the
President Pro Tem of the Senate and two representatives appointed
by the Speaker of the House of Representatives.  The commission
must:

(1)  Identify proposed federal legislation that infringes on the
state's sovereignty under the Tenth Amendment to the United
States Constitution;

(2)  Advise and make recommendations to the Missouri General
Assembly regarding any state legislation necessary to preserve
the integrity and principles of the Tenth Amendment;

(3)  Require each member of the Missouri Congressional delegation
to make himself or herself available to the commission annually
to answer inquiries regarding all votes cast or intended to be
cast on proposed federal legislation that may affect the state's
sovereignty;

(4)  Refer cases to the Attorney General when the federal
government takes steps that require the state or a state officer
to enact or enforce a provision of federal law that lies outside
Congress's enumerated powers and intrudes on the sovereignty
reserved to the states by the Tenth Amendment; and

(5)  Hold an annual meeting at which it must elect from its
membership a chairperson and vice-chairperson.

The bill contains a referendum clause and will be submitted to
qualified voters in August 2010.
