AN ACT

To amend chapter 571, RSMo, by adding thereto one new section relating to the illegal possession of a firearm magazine, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 571, RSMo, is amended by adding thereto one new section, to be known as section 571.024, to read as follows:

            571.024. 1. For the purposes of this section, the term “high capacity firearm magazine” shall mean a compartment of a firearm in which cartridges are held to be fed into the firing chamber and is capable of holding ten or more rounds of ammunition.

            2. A person commits the crime of possession of a high capacity firearm magazine if such person knowingly possesses, owns, uses, manufactures, purchases, or sells such a magazine.

            3. A violation of this section is a class D felony.

            4. No person shall be prosecuted under the provisions of subsection 2 of this section for the possession of any high capacity firearm magazine that was in his or her possession prior to August 28, 2013. However, the person may be prosecuted for any other violation of subsection 2 of this section.

            5. The provisions of subsection 2 of this section shall not apply to a law enforcement officer whose possession, ownership, use, manufacture, purchase, or sale of a high capacity firearm magazine occurs in the performance of his or her official duties.
