Summary of the Introduced Bill

HB 1908 -- Automated Speed Enforcement in Work Zones

Sponsor:  St. Onge

This bill allows the Highways and Transportation Commission to
enter into agreements with the State Highway Patrol to install
and use automated speed enforcement systems in work zones when
workers are present.  "Automated speed enforcement system" is
defined as a device using photographic, radar, laser, or
electrical or mechanical devices designed to record the speed of
a motor vehicle and obtain a clear photograph or other recorded
image of the motor vehicle, the operator, and the vehicle's
license plate at the time the vehicle is used or operated in
violation of the posted speed limit in a construction or work
zone.

The bill:

(1)  Specifies the procedures which the commission must follow
when establishing an automated speed enforcement system in a
construction or work zone;

(2)  Authorizes the patrol to issue a summons for speeding
violations when using the automated system in a construction or
work zone;

(3)  Specifies the process for the delivery of a summons to a
violator and the information required on a summons;

(4)  Specifies the evidentiary process;

(5)  Creates penalties and point assessment for violations;

(6)  Makes any owner of a motor vehicle issued a summons liable
for the payment of a fine, court costs, or any criminal penalty;
and

(7)  Provides for violations involving stolen, rented, or leased
vehicles.

The provisions of the bill will expire August 28, 2013.
