HB493I-PUBLIC WATER SUPPLY DISTRICTS
Summary of the Introduced Bill

HB 493 -- Public Water Supply Districts

Sponsor:  Scavuzzo

Currently, any territory included in a water supply district that
is not being served by the district may be removed by the filing
of a petition with the circuit court in which the district was
incorporated, either by the district acting through the board of
directors or by resident voters or landowners in the territory to
be detached.

If the petition is not submitted by the district acting through
its board of directors, this bill:

(1)  Requires the petitioner to serve a copy of the petition upon
the district by certified or registered mail with a return
receipt requested within 10 days of the filing;

(2)  Requires the circuit court clerk to give the district notice
of the hearing date by certified or registered mail with a return
receipt requested; and

(3)  Authorizes the district to file exceptions or objections to
the detachment.
