HB 327 -- Criminal Action With a Firearm

This bill creates the crime of criminal action with a firearm.
A person commits this crime when he or she commits any crime
through the use, assistance, or aid of a firearm. In addition
and consecutive to any punishment for the crime committed
through the use, assistance or aid of a firearm, the person must
serve at least a 10 year sentence without the possibility of
parole, probation, conditional release, or suspended imposition
or execution of sentence. If the offender does not have a prior
felony conviction, then he or she will be eligible for parole,
probation, conditional release, or suspended imposition or
execution of sentence. A person will not be guilty of criminal
action with a firearm and armed criminal action if the
underlying basis of the crime committed through the use,
assistance, or aid of a firearm arises out of the same conduct.
