HB 681 -- School Attendance Requirements for AFDC

This bill requires children between the ages of 5 and 18 years
to regularly attend school as a condition of eligibility for the
Aid to Families with Dependent Children (AFDC) cash grant.
Children who have graduated from high school, who have received
a high school equivalency diploma, or who attend home schooling
are exempted from this requirement. Provisions for obtaining
school attendance information from parents and from the schools
are outlined. The cash needs of the child who does not
regularly attend school are removed from the AFDC cash grant.
If a determination is made that a child has failed to regularly
attend school, written notification of the reduction in the cash
grant and the right of the child or parent of the child to
request a hearing must be given by the Department of Social
Services. The bill's provisions are effective 90 days after the
revisor of statutes has been notified that a federal waiver has
been obtained by the Department.
