HCS HB 1185 -- ADMINISTRATIVE RULE WAIVERS FOR SCHOOL DISTRICTS

This substitute gives the State Board of Education authority to
modify or waive any board rule or policy upon receipt and
approval of a proposal from a school district. Proposals for
waiver must demonstrate that the intent of the particular rule
can be locally addressed in a more effective, efficient, and
economical manner. Prior to submitting a waiver application, a
school district must hold a public hearing on the matter.
Waivers are limited to a maximum of 3 school years but may be
renewed upon application by the school district. The state
board may not waive any statutory requirement concerning teacher
certification or tenure.
FISCAL NOTE: Cost to General Revenue Fund of $50,832 in FY 97,
$54,466 in FY 98, and $55,856 in FY 99.

PROPONENTS: Supporters say that this bill would grant school
districts, with the approval of the State Board of Education,
the flexibility to address their particular needs. The
legislation is based on a similar Illinois law, which has been
successful.
Testifying for the bill were Representatives McClelland and
Kauffman; Cooperating School Districts of Greater Kansas City;
and Missouri School Boards Association.
OPPONENTS: There was no opposition voiced to the committee.
