HB 826 --Local Acquisition of Real Property

This bill establishes procedures for a city, town or village to
come into possession of real property located outside its
corporate limits. A city, town, or village must first determine
that the ownership of such real property is in the best interest
of the locality. Notice of the determination must be published
in newspapers of general circulation within the locale. A
notice of the time and place of a public hearing must be
published. At this hearing in open session any order or
ordinance to approve the acquisition must be approved.
The use of real property located outside corporate limits of a
city town, or village acquired by gift or any other voluntary
transfer may not be altered if the interest in the real property
came into possession after the effective date of this bill
unless the same procedures as listed above are followed.
Exceptions to these requirements apply to interests in real
property assumed prior to the effective date of this section and
to airports or port authorities.
