PERFECTED

HJR 42 -- DISTRIBUTION OF FORFEITURE PROCEEDS (Hosmer)

This proposed constitutional amendment divides proceeds from
forfeitures for any breach of penal law as follows: 50% to the
state school moneys' fund; and 50% to be appropriated by the
General Assembly for training of peace officers, for
distribution to local law enforcement agencies and prosecuting
attorneys as determined by law.

FISCAL NOTE:  Estimated Net Cost to General Revenue Fund of
$23,600 in FY 97.

SPONSOR:  Hosmer

COMMITTEE ACTION:  Voted "do pass" by the Committee on Civil and
Criminal Law by a vote of 14 to 1.

This proposed constitutional amendment divides proceeds from
forfeitures for any breach of penal law as follows: 50% to the
state school moneys' fund; and 50% to be appropriated by the
General Assembly for training of peace officers, for
distribution to local law enforcement agencies and prosecuting
attorneys as determined by law.

FISCAL NOTE:  Estimated Net Cost to General Revenue Fund of
$23,600 in FY 97.

PROPONENTS:  Supporters say that the resolution will change the
Missouri Constitution to divide forfeiture proceeds and assets
by 50% to police and 50% to the schools.

Testifying for the bill were Representative Hosmer; Missouri
Highway Patrol; Missouri Police Chiefs Association; and Missouri
Sheriffs Association.

OPPONENTS:  Those who oppose the bill say that the legislature
should wait before passing this legislation.  A U.S. Supreme
Court decision on forfeiture proceeds is pending.

Testifying against the bill was American Civil Liberties Union.
