INTRODUCED

HB 726 -- Transportation and Patrol Retirement

Sponsor:  Hagan-Harrell

Members of the Highways and Transportation Employees' and
Highway Patrol Retirement System first employed after August 28,
1997, who retire and are then elected or appointed to any state
office or employed by a department covered by the Missouri State
Employees' Retirement System are not entitled to receive
retirement benefits for any month during which they serve as an
official or employee.  Upon leaving such office or employment,
retired members are entitled to the same benefits they received
before serving in such position or employment.  Currently,
members collecting disability benefits may retire or elect to
continue receiving disability benefits when they become eligible
to retire; under this bill, members who retire while receiving
disability benefits will have retirement benefits calculated as
though they had continued in active service until their normal
retirement age and their compensation had been their rate of pay
immediately preceding the date of disability.  A provision that
made members receiving disability benefits before August 28,
1995, eligible to receive such benefits in accordance with prior
eligibility requirements is extended to cover employees
receiving such benefits before August 28, 1997.
