BILL SUMMARIES

HB 679, HCA 1 -- SALE OF AGRICULTURAL PROPERTY

SPONSOR:  Leake

COMMITTEE ACTION:  Voted "do pass" by the Committee on
Agriculture by a vote of 20 to 2.

This bill requires that before any contract for the sale of
agricultural property or property bordering on agricultural
property is entered into, the seller is to provide notice to the
prospective buyers that the property lies within an agricultural
area in which farming activities occur and that such farming
activities may cause noise, dust, and odors.  The notice is to
be signed by both the buyer and seller of the property prior to
sale and is to be recorded and may be included on the deed.
Failure to provide such notice would make the land purchase
voidable by the buyer.

HCA 1 -- Provides that no person not a party to the contract for
the sale of the property is liable to either party for any claim
arising from or related to the giving of information required by
the bill.

FISCAL NOTE:  Not available at time of printing.

PROPONENTS:  Supporters say that by the bill requiring the
seller of agricultural property to disclose the existence of
agriculture related activities proximate to the property,
certain nuisance suits can be avoided.

Testifying for the bill was Representative Leake.

OPPONENTS:  There was no opposition voiced to the committee.
