AN ACT

To repeal section 386.040, RSMo 1994, relating to the public service commission, and to enact in lieu thereof one new section relating to the same subject.

Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 386.040, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 386.040, to read as follows:

386.040. [A "Public Service Commission" is hereby created and established, which said public service] The public service commission shall hereafter be known as the "Commission". The commission shall be vested with and possessed of the powers and duties in this chapter specified, and also all powers necessary or proper to enable it to carry out fully and effectually all the purposes of this chapter.
