COMMITTEE

HB 1208 -- PROBATE

SPONSOR: Fitzwater

COMMITTEE ACTION: Voted "do pass by consent" by the Committee
on Civil and Administrative Law by a vote of 16 to 0.

Under current law, a spouse who is a guardian or conservator of
a ward is removed from such position upon the dissolution of the
marriage. This bill allows the former spouse to be reappointed
as guardian or conservator.

FISCAL NOTE: No impact on state funds.

PROPONENTS: Supporters say that current law removes a spouse as
conservator automatically upon a dissolution, without a
hearing. The court should have the authority to reinstate the
former spouse as conservator when the circumstances warrant it.

Testifying for the bill was Representative Fitzwater.

OPPONENTS: There was no opposition voiced to the committee.
