Cases can be prosecuted in the county or counties where any element of the offense took place, in the county where the defendant or victim resides, or in the county where the property was located. FISCAL NOTE: No impact on state funds.
HB 1358 -- CREDIT CARD FRAUD SPONSOR: Loudon COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Criminal Law by a vote of 18 to 0. This bill establishes venue in cases of criminal credit card fraud. Cases can be prosecuted in the county or counties where any element of the offense took place, in the county where the defendant or victim resides, or in the county where the property was located. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that the bill will allow crimes to be filed in the victim's home county, preventing credit card fraud from going unpunished because the thief has left the jurisdiction.
