HB 1573 -- Claims Against Professionals

This bill requires the plaintiff to file an affidavit in a civil
action against a licensed architect, professional engineer, land
surveyor, or a corporation authorized to perform those
professional services. The affidavit must state that the
plaintiff has obtained, from a professional with the same type
of license as the defendant, a written opinion asserting that
the defendant failed to use the care that a reasonably careful
professional would have used under similar circumstances and
that the failure to use that care caused or contributed to cause
the damages claimed by the plaintiff. The affidavit must also
state the qualifications of the professional offering the
opinion. If the affidavit is not filed within 90 days of filing
the petition, the court may dismiss the action. The bill's
provisions do not apply to actions filed in small claims court.
