HB 1985 -- Registration of Sex Offenders

Co-Sponsors: Myers, Chrismer

This bill requires sex offenders to be assessed when the
offender is released into the community due to completion of
sentence or at the order of the court or when the Department of
Corrections is notified by another state that an offender is
residing, working, or going to school in this state.

The assessment should be completed at least 90 days before
release. The Department of Corrections must evaluate the
offender, based on a number of factors, to determine whether the
offender should be classified as a low, moderate, or high risk.
Each risk categories requires a more stringent notification
requirement.

When an offender is determined to be low risk, the Department of
Corrections must notify victims, the departments of Public
Safety and Social Services, and local law enforcement and must
disclose to the public whether an individual is registered, the
crime committed, and the local office of the Department of
Corrections supervising the offender when requested. If the
offender is found to be a moderate risk, the Department of
Corrections may also notify local schools and day care centers
near the offender's residence and must disclose to the public
the offender's address upon request. For high risk offenders,
the Department of Corrections may notify neighbors of the
offender and must provide photographs and motor vehicle
descriptions to the public when requested.
