HB 2127 -- Terms of Probation

This bill allows the state and the defendant to both make
motions to the circuit court for probation. Currently, only the
court can make such a motion. The bill makes all defendants
eligible for probation, if otherwise qualified, unless the court
enters findings of facts at sentencing that would prohibit
placing the defendant on probation. If the court makes those
findings of facts, it must enter a written decision specifying
the reason why the defendant is not eligible for probation.
