HB 2156 -- Child Custody
Sponsor: Patek
This bill adds to the list of factors that a court must consider
when making a child custody determination, the cohabitation of
either parent with another person to whom such parent is not
married. The bill also requires a court to modify a prior
custody decree awarding custody to a nonparent if it finds, on
the basis of facts that have arisen since the prior decree or
were unknown to the court at the time of the prior decree, that
a change has occurred in the circumstances of the parent seeking
custody, the reason(s) for awarding custody to the nonparent
have abated, the parent seeking custody is fit, and awarding
custody to the parent serves the best interest of the child.
