AN ACT

To repeal section 167.645, RSMo Supp. 1999, relating to peer promotion of pupils, and to enact in lieu thereof one new section relating to the same subject.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 167.645, RSMo Supp. 1999, is repealed and one new section enacted in lieu thereof, to be known as section 167.645, to read as follows:

167.645. No third grade public school student shall be promoted to [a higher grade level] the fourth grade unless that student has a reading ability level at or above [one grade level below the student's] the second grade level; except that the provisions of this subsection shall not apply to students receiving special education services pursuant to sections 162.670 to 162.999, RSMo.
