AN ACT

To repeal section 221.044, RSMo 1994, relating to children in jails, and to enact in lieu thereof one new section relating to the same subject.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 221.044, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 221.044, to read as follows:

221.044. No person under the age of seventeen years, except those transferred to the court of general jurisdiction [under] pursuant to the provisions of section 211.071, RSMo, shall be detained in a jail or other adult detention facility as that term is defined in section 211.151, RSMo. Any person under the age of seventeen years transferred to the court of general jurisdiction pursuant to the provisions of section 211.071, RSMo, shall be detained in separate quarters from persons seventeen years of age or older if detained in a jail or other adult detention facility. A traffic court judge may request the juvenile court to order the commitment of a person under the age of seventeen to a juvenile detention facility.
