AN ACT

To amend chapter 304, RSMo, relating to traffic regulations by adding thereto one new section relating to cellular or mobile telephone use, with penalty provisions.



Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 304, RSMo, is amended by adding thereto one new section, to be known as section 304.145, to read as follows:

304.145. 1. No person shall operate any moving motor vehicle on any highway, street or road while operating a cellular or digital mobile telephone.

2. The provisions of subsection 1 of this section shall not apply to:

(1) Use of such telephone to contact emergency personnel; or

(2) Use of such telephone by emergency personnel in the performance of their duties.

3. Any person who violates the provisions of subsection 1 of this section is guilty of a class B misdemeanor, unless an accident is involved, in which case the person shall be guilty of a class A misdemeanor.
