AN ACT
To amend chapter 188, RSMo, relating to sale of fetal body parts by adding thereto one new section relating to the same subject, with penalty provisions.
Section A. Chapter 188, RSMo, is amended by adding thereto one new section, to be known as section 188.460, to read as follows:
188.460. 1. As used in this section, the term "fetal tissue" means tissue from a fetus or child who is stillborn or aborted.
2. Any person who intentionally acquires, receives, sells or transfers, or trades or barters an intact fetus or whole body of an unborn child, or fetal tissue, organs or body parts from a fetus or child that is aborted is guilty of a class C felony. Such unlawful conduct shall include the acquisition, receipt, sale or transfer, or trades or barters of such fetal tissue, organs or body parts.
3. Nothing in this section shall be construed to condone or prohibit the performance of diagnostic tests while the
unborn child is in utero or the performance of pathological examinations of an aborted child, nor shall anything in
this section be construed to condone or prohibit the performance of in vitro fertilization and accompanying
embryo transfer.
