AN ACT

To repeal section 407.469, RSMo 1994, relating to disclosures of certain fund-raising costs, and to enact in lieu thereof one new section relating to the same subject.




Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Section 407.469, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 407.469, to read as follows:

407.469. 1. All charitable organizations required to submit an annual report under section 407.462 shall, upon request, disclose the percentage of the funds solicited which were spent on the costs of fund raising in the last twelve-month period for which an annual report was filed under section 407.462. For purposes of this section, costs of fund raising shall include all money directly expended on fund raising and that portion of all administrative expenses and salaries of the charitable organization attributable to fund-raising activities. [Any person who markets or collects funds on behalf of a charitable organization shall state on all literature soliciting such funds that a portion of the funds contributed are used for marketing expenses and paid to persons for marketing the charitable organization, if any such funds are so used.]

2. All persons making solicitations, other than solicitations on behalf of the organizations, institutions and purposes listed in subsection 2 of section 407.456, shall, at the time a solicitation is made, disclose the percentage of funds solicited which were spent on the charitable purpose of the charitable organization during the last twelve-month period for which an annual report was filed pursuant to section 407.462. Whenever a solicitation of funds on behalf of a charitable organization is undertaken by a professional fundraiser[,] and not someone who is a member, regular employee or volunteer of the charitable organization, then the professional fundraiser shall disclose [that fact] to prospective contributors, at any time a solicitation is made, the fact that the solicitation is being made by a professional fundraiser.
