AN ACT

To amend chapter 188, RSMo, relating to abortion by adding thereto one new section relating to the same subject.


Be it enacted by the General Assembly of the state of Missouri, as follows:

Section A. Chapter 188, RSMo, is amended by adding thereto one new section, to be known as section 188.026, to read as follows:

188.026. 1. Prior to the performance of an abortion, a physician shall inform a pregnant woman, both verbally and in writing, of her right to view her sonogram prior to the performance of the procedure and shall provide her with the opportunity to view such sonogram. The pregnant woman shall sign a written waiver if she declines her right to view the sonogram. Such waiver or a written confirmation of such viewing shall be included in the pregnant woman's medical file maintained by the physician and, except as provided in subsection 2 of this section, shall be treated as a confidential medical record.

2. The department of health shall collect demographic data from physicians on the number of pregnant women who view their sonograms and the number of pregnant women who sign the written waiver declining to view their sonograms in accordance with subsection 1 of this section. Such data shall be submitted to the department and treated as confidential information used for statistical purposes only. Pregnant women shall have the option of providing their names or in lieu thereof, being assigned an identification number. To ensure the accuracy of the demographic data collected, the department may review all medical files for pregnant women maintained by a physician for the limited purpose of verifying the presence of such waivers or written confirmations in such files.
